Privacy Policy

Data Controller: Allela Ventures Ltd ("CADDY UP", "we", "us", "our"), P.O. Box 29832-00100, Nairobi, Kenya.

This Privacy Policy explains how CADDY UP collects, uses, shares, and protects your personal data when you use the CADDY UP application, website, and services (the "Platform"). We process personal data in accordance with the Data Protection Act, 2019 of Kenya and applicable regulations. By using the Platform, you acknowledge this Policy.

1. Information We Collect

Information you provide

  • Account information: name, email address, phone number, password, and role (Golfer or Caddie).
  • Profile information: for Caddies, this may include experience, badge level, languages spoken, rates, availability, profile photo, and information used to verify identity or eligibility.
  • Booking information: the courses, dates, tee times, and rounds you book or provide.
  • Payment-related information: details needed to process payments and payouts. Card and mobile-money payments are handled by our payment partners; we do not store full payment card numbers.
  • Communications and reviews: messages sent through the Platform, reviews, ratings, and support enquiries.

Information collected automatically

  • Device and usage data: device type, operating system, app version, identifiers, IP address, log data, and how you interact with the Platform.

Location information

  • With your permission, we use your device's GPS location to show nearby golf clubs and available caddies. You can enable or disable location access at any time in your device settings; disabling it may limit location-based features.

Information from third parties

  • Confirmation of payment status from our payment partners, and golf-club reference information.

2. How We Use Your Information

We use personal data to:

  • Create and manage your account and provide the Platform's features;
  • Match Golfers with Caddies and enable and verify bookings (including tee check-in and round confirmation);
  • Process payments and Caddie payouts;
  • Maintain safety and integrity, including fraud detection and moderation;
  • Communicate with you about bookings, support, and service updates;
  • Improve and develop the Platform; and
  • Comply with legal obligations and enforce our Terms.

3. Legal Bases for Processing

Depending on the context, we rely on: your consent (e.g., location access and certain communications); performance of a contract (providing the service you request); our legitimate interests (operating, securing, and improving the Platform); and compliance with legal obligations.

4. How We Share Information

We share personal data only as needed to operate the Platform:

  • With the other party to a booking: Golfers and Caddies see the information necessary to coordinate a round (such as name, relevant profile details, and booking information).
  • With payment partners: including Safaricom M-Pesa and our payment service providers, to process payments and payouts.
  • With service providers: including our application hosting/platform provider and analytics providers, who process data on our behalf under appropriate obligations.
  • For legal reasons: to comply with the law, respond to lawful requests, or protect the rights, safety, and property of CADDY UP, our users, or the public.
  • In a business transfer: in connection with a merger, acquisition, or sale of assets, subject to this Policy.

We do not sell your personal data.

5. Data Retention

We retain personal data for as long as your account is active and as needed to provide the Platform, then for as long as necessary to comply with legal, tax, accounting, dispute-resolution, and fraud-prevention requirements, after which we delete or anonymise it.

6. Data Security

We use reasonable technical and organisational measures to protect personal data against unauthorised access, loss, or misuse. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your Rights

Subject to applicable law, you have the right to: access your personal data; request correction of inaccurate data; request deletion; object to or restrict certain processing; request portability; and withdraw consent at any time (without affecting prior lawful processing). To exercise these rights, contact us using the details below. You may also lodge a complaint with the Office of the Data Protection Commissioner (ODPC) of Kenya at www.odpc.go.ke. You can request account deletion at any time through our Delete Account page.

8. Children's Privacy

The Platform is intended for adults. Account holders must be 18 or older, and we do not knowingly create accounts for or knowingly collect personal data from children under 18. Where a minor plays a round, an adult account holder books and supervises that round; we do not require the minor to register or provide personal data to us. If we learn that we have inadvertently collected personal data from a child under 18, we will delete it promptly. If you believe a child has provided us personal data, please contact us.

9. International Data Transfers

Some of our service providers and payment partners may process data outside Kenya. Where personal data is transferred internationally, we take steps to ensure it is protected consistently with this Policy and applicable law.

10. Cookies and Analytics

We and our analytics providers may use cookies and similar technologies to operate the Platform, remember preferences, and understand usage so we can improve the service. You can manage some of these technologies through your browser or device settings.

11. Third-Party Links

The Platform may link to third-party sites or services we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy policies.

12. Changes to This Policy

We may update this Policy from time to time. For material changes we will provide notice through the app or by other appropriate means. The "Effective Date" indicates when this Policy was last updated.
